Title: A Comparative Analysis of the Public's Right to Access Natural Resources in Iran and France: From Juridical-Theological Foundations to Modern Executive Challenges

چکیده :
Abstract This paper provides a comparative analysis of the legal frameworks governing public access to natural resources in Iran, rooted in Imami Shi'a jurisprudence, and France, a descendant of the Romano-Germanic tradition. Employing a comparative-analytical method, it argues that while both nations constitutionally recognize this right, a significant implementation gap exists in Iran. This gap stems from a complex legal-institutional ecosystem, including legal coherence, judicial efficacy, administrative decentralization, civil society's role, and the interpretation of "public interest." The findings reveal that France's system, integrating the Public Domain doctrine with robust oversight, has been more effective. In contrast, Iran's system grapples with legal fragmentation, contested interpretations of Anfal, and centralized governance. The article concludes by proposing a framework for a modern reinterpretation of the Anfal concept within good governance and sustainable development paradigms, offering a path to bridge the
